Terms of Service

Welcome to SnapCaption. These Terms of Service (“Terms”) govern your access to and use of the SnapCaption code replacement file generation service for sports photography (“Service”). By accessing or using SnapCaption, you agree to be bound by these Terms.

1. Acceptance of Terms

By using SnapCaption, you acknowledge that:

• You are at least 18 years old or have parental consent to use the Service
• You have the legal capacity to enter into this agreement
• You will comply with all applicable laws and regulations
• You accept these Terms in their entirety

2. Service Description

SnapCaption provides:

• Code Replacement Files: Generation of TSV files for sports photography captioning
• Roster Management: Access to current player rosters for NBA, NFL, NHL, MLB, MLS, NWSL, and NCAA sports
• Custom Code Storage: Ability to save and manage your commonly used caption codes
• Export Options: Multiple methods to export and use your generated files

3. Accounts and Membership

Account Creation

• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• You must notify us immediately of any unauthorized access

Pro Membership

Pro Membership provides enhanced features including:

• Unlimited code replacement file generation
• Advanced customization options
• Priority support
• Cloud storage of custom codes

4. Payment Terms

Subscription Billing

• Billing Cycle: Subscriptions are billed on a recurring monthly or annual basis
• Auto-Renewal: Your subscription will automatically renew unless cancelled
• Price Changes: We will provide 30 days notice before any price increases
• Payment Processing: All payments are processed securely through our third-party payment providers

Refund Policy

Refunds may be available within 7 days of initial purchase if you have not substantially used the Pro features. Contact support for refund requests.

5. Acceptable Use Policy

You May:

• Use the Service for professional and personal photography work
• Create and store custom codes for your workflow
• Export files for use with photo editing software
• Share your account benefits with your immediate team members

You May Not:

• Resell, redistribute, or sublicense the Service or roster data
• Use automated systems to scrape or harvest data
• Attempt to reverse engineer or hack the Service
• Use the Service for any illegal or unauthorized purpose
• Violate any sports league’s terms regarding data usage
• Share account credentials with unauthorized users

6. Intellectual Property Rights

Our Rights

SnapCaption owns all rights to:

• The Service platform and software
• The user interface and design
• Our proprietary data compilation methods
• The SnapCaption name, logo, and branding

Your Rights

You retain ownership of:

• Custom codes you create
• Your personal workflow preferences
• Any original content you input into the Service

License Grant

By using the Service, you grant us a limited license to store and display your custom codes solely for the purpose of providing the Service to you.

7. Data Accuracy Disclaimer

• Roster data is obtained from various sources and updated regularly
• Player trades, injuries, and roster changes may not be immediately reflected
• You are responsible for verifying information for critical uses
• We are not liable for any errors or omissions in the data

8. Limitation of Liability

Service Warranty

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Liability Limits

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, special, or consequential damages
• Our total liability shall not exceed the amount you paid for the Service in the past 12 months
• We are not responsible for lost profits, data loss, or business interruption

Indemnification

You agree to indemnify and hold SnapCaption harmless from any claims, damages, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable laws

9. Termination

Your Right to Terminate

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period.

Our Right to Terminate

We may suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent activity
• Your payment method fails
• We discontinue the Service

Effect of Termination

• Your access to Pro features will cease immediately
• Your custom codes may be deleted after 30 days
• No refunds will be provided for partial billing periods
• Sections of these Terms that should survive termination will remain in effect

10. Changes to Terms

We reserve the right to modify these Terms at any time. When we do:

• We will update the “Effective Date” at the top of this page
• We will notify you via email for significant changes
• Your continued use after changes constitutes acceptance
• If you disagree with changes, you should discontinue use of the Service

11. General Provisions

Governing Law

These Terms are governed by the laws of the United States and the State of Oregon, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in Oregon, except where prohibited by law.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and SnapCaption regarding the Service.

12. Sports Data and Photography

• We are not affiliated with or endorsed by any sports league
• League trademarks are property of their respective owners
• Users must respect intellectual property rights of leagues and teams
• Photography at events is subject to venue and league policies
